NYPD were called to a robbery and a shooting at a building on W. 38 St. near Eighth Ave. about 1:15 p.m. January 6th.

Police said the victim rode the elevator with his Taylor to the seventh floor, when the victim was shot by a thief. He was rushed to Bellevue Hospital in stable condition but he developed a blood clot and died on February 4th. the city Medical Examiner has deemed the case a homicide.

Richard Johnson, 34, was arrested Jan. 27th and charged with robbery and assault. A second suspect Jarel Moore, 38, was arrested on February 5th and charged with robbery and assault.

Police have not said if those charges will be upgraded.
