NYPD were called to the report of a shooting near the parking garage of an apartment building at 123-20 82nd Ave. on May 31st at around 2:00am.

Police arrived to find Cody Gonzalez, 32, with gunshot wounds to his chest. He was pronounced at the scene.

Investigators said they believe that Gonzalez had pulled a sharp object on Foehner in an attempt to rob him. According to reports, Charles Foehner, 65, then pulled a .38 caliber Smith & Wesson revolver and shot Gonzalez.

So far Foehner has only been charged with 26 counts of criminal possession of a weapon.
