NYPD were called to the Fish Express Fish Market after Malik Burrell, 25, and Robert ‘Bobby’ Burrell, 29, were both stabbed on February 21st.
According to reports, the brothers allegedly attempted to steal some shrimp when an employee, Junior Hernandez, 34, grabbed a knife and stabbed both men in the abdomen. Police said the weapon was a work knife. Both men were rushed to Harlem Hospital where Malik died of his injuries.
Hernandez, who has no known prior criminal history, has been arrested.
Update: The Manhattan District Attorney’s office declined to press murder charges against Junior Aquino Hernandez, 34.
According to court reports, a worker attempted to stop Burrell from leaving the store with the stolen shrimp. Burrell dropped the shrimp and punched the worker in the face. He returned minutes later with his brother Malik Burrell, they entered the store, the employees were behind the counter in area for employees only. Malik Burrell punched an employee repeatedly in the face and head, and Hernandez attempted to separate the two. Hernandez then grabbed a knife. Malik Burrell, according to court documents, was still punching the employee in the face and head at which point Hernandez stabbed him twice in the torso.
Mireille Dee, the assistant district attorney, said “At this time, we are not prepared to go forward on any charges related to the death of Malik Burrell pending a full and complete investigation. We are, however, filing charges with regard to the incident at the door for the stabbing of Robert Burrell.”
