Charges Dropped – 35-year-old Austin Simon stabbed to death by a bodega worker

NYPD responded to a stabbing at a bodega located at 3422 Broadway at approximately 11:07 p.m. on July 1st.

According to reports, 51-year-old bodega worker, Jose Alba, got into a verbal altercation with the victim who was known to the business. The 51-year-old worker allegedly stabbed 35-year-old Austin Simon twice in the chest, and once in the neck.

Police and paramedics arrived to find the victim suffering from serious injuries. He was rushed to Harlem Hospital, where he was pronounced deceased.

According to reports, the altercation was a result of Austin Simon’s girlfriend’s debit card being declined when she tried to buy a bag of chips.

Update: Jose Alba is facing a charge of second-degree murder and remains at Rikers Island jail on $250,000 bail. Alba has no known criminal history and says the homicide was an act of self defence.

On Thursday July 7th Jose Alba was freed from Prison after his charge was lowered to self-defense case.

Update July 21st
Manhattan District Attorney Alvin Bragg has dropped the homicide charge against Jose Alba stating there wasn’t enough evidence to prosecute the case.
