The NYPD said 82-year-old Dean Conover Whetzel was pushed to the ground on October 11th outside a café near Hudson Street and West 10th Street.

Officers arrived around 1:30 p.m. to find him unconscious on the sidewalk with a swollen eye and a head injury.

Whetzel was rushed to Bellevue Hospital in critical condition. Police arrested 79-year-old Dana Escoffier, charging him with assault and a weapons offense.

Whetzel remained in the hospital until November 5th, when he died from his injuries. The city’s medical examiner ruled his death a homicide the following day.

According to police, Whetzel and Escoffier did not know each other, though both lived near the intersection where the assault took place.
